  • David was selected as a 2016 Top Attorney by Birmingham magazine. David was featured in the magazine’s April 2016 publication. This is the fifth year in a row David has been selected. DAVID P. NOMBERG SELECTED AS TOP ATTORNEY BY BIRMINGHAM MAGAZINE
  • We are both active in the Birmingham Bar Association.  We have been members of several of the Bar’s committees over the years. David is currently serving on the Executive Committee for the 3rd year.  Recently the Bar undertook a major renovation to the Noojin Courtyard.  We made a financial contribution to help support this beautiful renovation. We are very proud to have helped support the renovation of this beautiful green space in downtown Birmingham.

  • Bernard attended the Alabama State Bar conference in June. Bernard is serving on the leadership of the Workers’ Compensation Section. Bernard also presented a case law update for attendees.
  • David recently joined the Alabama Civil Justice Foundation Board of Directors. David is serving his second year on the Alabama Association for Justice Board of Directors.

  • Part of our Firm’s mission is to help people in the courtroom as well as out of the courtroom. We recently helped with the flood relief in Louisiana by making a financial contribution through the Alabama Civil Justice Foundation.   • Our Firm is hosting a tailgate and continuing legal education seminar in Arlington, Texas on September 3, 2016. “Tailgating and Trial Lawyers CLE” will take place the morning of the Alabama/USC game. The CLE is being jointly sponsored by our Firm and Hodges Trial Lawyers. It will take place right down the street from AT&T Stadium.   • Bernard filed suit for a client who was injured on the job while working for a construction company in Jefferson County, Alabama. Our client was working in the line and scope of his employment for the Defendant as a pipe fitter/welder when he was injured. He was removing a burner pipe on a boiler when he stepped into a scaffold pole that should have been removed, thereby injuring his neck. He needs surgery to repair the injuries but the employer is disputing the claim. They believe that he has pre-existing injuries. That’s why we filed suit.
  • Bernard recently filed suit in Tallapoosa County for a client who was injured while working in Denver, Colorado. Our client was working for an Alabama construction company at a new apartment complex when he injured his lower back and right knee. The client was injured when he fell off a truck while preventing a heavy pump from falling on top of him. Hopefully through litigation we will be able to secure the proper medical care that he needs and eventually get him compensated for his injuries.
  • David filed suit in Pike County for a client who injured his shoulders while lifting a column. He was diagnosed with a torn rotator cuff resulting in surgery. Unfortunately, he continues to have residual problems in both arms and permanent work restrictions make it difficult for him to perform his job.
  • Bernard attended a settlement hearing in Talladega County. Our client is a local sheriff’s deputy who injured his leg, ankle and foot while chasing a suspect. After conservative medical care, our client returned to work full duty.
  • Bernard filed suit in Calhoun County for a client who was injured on the job. Our client injured his low back while working as a maintenance technician. Employer denied the claim using pre-existing condition as a defense. Client was left with no choice but to file suit.
  • A few months ago, Bernard tried a workers ‘ compensation case in Lee County. Our client injured his back while doing sheetrock work at a new construction site. The claim was disputed so the client was forced to file a lawsuit and try the case before a judge. We are pleased to report that this case recently settled.
  • A case out of St. Clair County was recently resolved by Bernard for a client against a construction company. The client injured his hand, neck, and right rotator cuff when he slipped in oil and fell into a hole on the assembly line. The client required three separate surgeries and, thankfully, he has made a near complete recovery. He has returned to work in a different capacity.
  • Bernard settled a case out of Montgomery County for an employee who was injured while cutting a metal coil with a torch. At the end of the cutting, the coil sprang open and struck him in his lower leg causing it to fracture. After a surgery and months of rehabilitation, the client has returned to work in a different capacity.
  • Bernard recently returned from Marshall County where he settled a claim for a gentleman who was injured when he slipped off of a ladder and fell down several feet. He injured his back, elbow, and ankle. He has since returned to work for a different employer.
  • Bernard settled a Tuscaloosa County case for a woman who was injured while working as a trainer at a high school football game. She severely injured one of her knees while responding to an injury on the field during a rainstorm. She has had multiple surgeries.
  • Bernard settled a Tuscaloosa County case for a gentleman who was injured when a heavy door slammed into his head. This accident jarred in his neck and back. Included in the settlement of that claim were also retaliation claims against the employer.
  • David reached a settlement at mediation for a local college employee injured at work. The case was filed in Jefferson County. Our client was injured while performing his job duties. As a result of his injuries, he had multiple back surgeries. The case settled for $145,000 with the employer responsible for paying for our client’s future medical needs.
  • David represents a Huntsville man injured in a work-related automobile collision. David’s client suffered tremendous head, face and body injuries. Following mediation, the claim settled for $130,000 with the employer responsible for our client’s future medical care. This was great result for a most-deserving client.

XARELTO – Xarelto is a blood thinner that has been directly linked to very serious side effects including internal bleeding, gastrointestinal bleeding, brain bleeding and death.

TALCUM POWDER – As many as 2,200 cases of ovarian cancer diagnosed each year may have been caused by regular use of talcum powder. Johnson & Johnson knew of the cancer risks associated with its talc products, but failed to warn consumers. Talc is ground to make talcum powder which is used to absorb moisture and is widely available in various products including baby powder and adult products including body and facial powder. Talc products used regularly in the genital area increase the risk of ovarian cancer.

PROTON PUMP INHIBITORS (Nexium, Prilosec, Previsid) – Over the counter proton pump inhibitors (PPIs) treat acid-related disorder of the upper gastrointestinal tract, including peptic ulcers and gastrointestinal reflux disorders. We are currently investigating PPI-induced Acute Interstitial Nephritis (AIN), which is a condition where the spaces between the tubules of the kidney cells become inflamed. The injury appears to be more profound in individuals older than 60. Most will suffer from some level of permanent kidney function loss. In rare cases individuals suffering from PPI-induced AIN will require kidney transplant.
